In this episode of The Urban debate with the host Shreya Dhoundial, the anchor will be discussingSupremeCourt’s landmark judgement on divorce.The five-judge bench constitution of the Supreme Court has ruled that marriages between two consenting parties can be dissolved on grounds of irretrievable breakdown. The top court has announced its verdict on a batch of petitions relating to the exercise of its worst power under Article 142 to dissolve broken marriages between consenting couples without referring them to the family courts. Today’s ruling makes it clear that the six-month period of waiting under the Hindu Marriage Act for divorce can be dispensed with in the case of an irretrievable marriage.
During the discussion one of our panellist, Family lawyer Mrunalini Desmukh said: “If one of the parties declines to agree for a divorce and both parties can’t see eye to eye – this is where the #SupremeCourt’s judgement is a landmark one. This means a lot to such couples.” Watch the video.
